RENTAL AGREEMENT-TERMS AND CONDITIONS
1. Lessee must be at least 18 years of age and have a valid driver's license.
2. Additional operators must be listed above and be at least 16 years of age with a valid driver's license.
3. Maximum of 4 persons in a 4 passenger golf cart. 6 persons in a 6 passenger golf cart.
4. Lessee is not permitted to lease vehicle to other parties.
5. Lessee is responsible for and will reimburse Kappy's Market, LLC on demand for any loss and/or damage of any kind or nature to vehicle tires, accessories, and equipment therein or thereon.
6. Lessee agrees to hold Kappy's Market, LLC harmless and to indemnify Kappy's Market, LLC against any loss arising out of lessee's operation of the leased vehicle or anyone who operates said vehicle with Lessee's permission. Lessee agrees to reimburse Kappy's Market, LLC for any loss they may sustain as a result of any claim made against them including reasonable attorney fees.
7. Lessee is responsible for any violations resulting from improper operations of vehicle.
8. Kappy's Market, LLC shall not be liable for loss or damage to any property left, stored, or transported by lessee or any other person in or upon vehicle either before or after the return thereof to Kappy's Market, LLC. Lesseee hereby assumes all risks of such loss or damage and waives all claims against Kappy's Market, LLC based upon or arising out of such loss or damage.
9. Golf Carts are to be operated on Golf Cart Paths only. Not on Sand or Beach.
10. Lessee agrees not to remove vehicle from Gasparilla Island.
11. Carts are electric and are required to be charged nightly after regular use. Kappy's Market, LLC will not be responsible for towing or emergency service of a vehicle which has exhausted its charge away from your home charging base. If your cart begins to slow down or you feel your charge may be low, immediately return to your home base and charge.
12. Chargers for electric golf carts must be kept out of the rain.
13. Any mechanical failure or damage must be reported as soon as possible. Do not push or tow golf cart. This may cause additional damage.
14. If you get a flat tire or encounter damage which interferes with the operation of the golf cart, STOP CART and notify us immediately for service. If you drive on a flat tire you will be charged for a new tire.
15. If golf cart is damaged beyond immediate repair at the fault of the Lessee and a suitable replacement is not available, Kappy's Market, LLC is not liable to reimburse Lessee for unused portion of rental agreement. Any security deposit will be held until damage claim is settled.
16. GOLF CARTS ARE OFTEN STOLEN AND SINCE YOU ARE RESPONSIBLE PLEASE REMOVE THE KEY WHEN NOT USING. LOST KEY CHARGE IS $5.00
17. When operating the golf cart you are doing so at your own risk. Any injury incurred by Lessee or your passengers shall not be deemed the fault of Kappy's Market, LLC.
18. Lessee has read and understands the rental agreement for golf carts on Gasparilla Island.
